Samsung Gets Galaxy Nexus Sales Ban Suspended Temporarily, Scores Victory Against Apple

WASHINGTON, July 6 (Reuters) - Samsung Electronics scored a partial victory against arch-foe Apple Inc on Friday after a U.S. appeals court lifted a freeze on sales of its Galaxy Nexus smartphones but upheld a lower court's decision to temporarily halt sales of its Galaxy 10.1 tablet computer.

Apple accused its Asian rival, the leader in global mobile device sales, in lawsuits of blatantly copying its hot-selling iPhones and iPads.

Last week, a San Jose court granted rare, temporary injunctions against the sale of the Galaxy mobile devices in question, a triumph for the Silicon Valley consumer electronics giant that had asked for the bans until their trial begins July 30.

Apple has waged an international patent war since 2010 as it seeks to limit the growth of Google's Android system, the world's most-used mobile operating platform. Opponents of Apple say it is using patents too aggressively in a bid to stamp out competition.

Apple and Samsung Electronics, the world's largest consumer electronics companies, are waging legal battles in about 10 countries, accusing each other of patent infringement as they vie for supremacy in a fast-growing market for mobile devices.

The U.S. Court of Appeals for the Federal Circuit said it would temporarily stay the smartphone injunction while it considers Apple's arguments, the court said in a brief order. It gave Apple a July 12 deadline to respond.

The decisions are the latest in a long-running battle between Samsung and Apple in U.S. courts but are unlikely to severely depress the Asian tech-power's bottom line since it is rolling out new tablet and smartphone models. On Friday, Samsung announced that soaring sales of its smartphones helped drive a record $5.9 billion quarterly profit.

Earlier this week, U.S. District Judge Lucy Koh in San Jose, California, rejected Samsung's request to lift her June 26 order to halt sales of the tablet, which runs on Google Inc's Android operating system and goes toe-to-toe with the iPad.

Koh also slapped a pre-trial ban on sales of Samsung's Galaxy Nexus phone a week ago.

Apple sued Samsung last year, accusing the South Korean electronics maker of "slavishly" copying the iPhone and iPad. Samsung denies the claim and countersued.

Samsung's Galaxy touchscreen tablets are considered by many industry experts to be the main rival to the iPad, though they are currently a distant second to Apple's devices.

Apple sold 13.6 million iPads from January through March to control 63 percent of the global tablet market, according to research from Display Search. Samsung sold 1.6 million tablets, giving it 7.5 percent of the market.

The Galaxy case is U.S. District Court, Northern District of California, is Apple Inc v. Samsung Electronics Co Ltd et al, 11-1846. The Nexus case is in the same court and is No. 2012-0630.

First Look: Galaxy Nexus and Android 4.0 Ice Cream Sandwich



For all the attractions of Google’s Android mobile operating system, many smartphones based on it have a quality to which no gadget aspires: They’re less than the sum of their parts. The hardware can be clunky. Device makers slather on modified interfaces that hurt rather than help. Wireless carriers add pesky junkware. Did I mention that Android phones are frequently stuck with obsolete versions of the operating system?
Google knows about these issues, and its “Pure Google” Nexus handsets—which offer great hardware, nicely integrated with unsullied, up-to-date versions of  Android—have aimed to sidestep them. Upon their release, both the Nexus One and the Nexus S became the best Android phones on the market. The only problem was that Android in its purest form was still nowhere near as refined as an iPhone.
Now there’s the Galaxy Nexus, a new Pure Google phone which is, like the Nexus S, a collaboration between Google and Samsung. It’s the first handset to feature Android 4.0 Ice Cream Sandwich, Google’s ambitious new upgrade. Judging from the brief time I’ve had with a unit loaned to me by Google, Ice Cream Sandwich makes the Galaxy Nexus a bit of a breakthrough. This phone lives up to its potential in ways that even the Nexus One and Nexus S did not.
The Galaxy Nexus that Google provided is an HSPA+ version that works with T-Mobile, but the first one to go on sale in the U.S. will run on Verizon Wireless’s zippy 4G LTE network. As I write, Verizon hasn’t announced availability and pricing; my guess is “real soon” and “$300 or thereabouts,” respectively.
One of Android’s defining features is the openness that permits device manufacturers to put it on phones that vary widely in features, size and style. Despite that, most major Android handsets are actually pretty darn similar. They’re big touchscreen slabs, with displays that dwarf the iPhone’s 3.5″ screen.
If that’s the kind of phone that appeals to you, you’re going to like the Galaxy Nexus. It has a 4.65″ Super AMOLED screen—expansive even by Android standards and packing 1280 by 720 pixels for true HD capability. As with the AMOLED displays on other Samsung phones, this one offers remarkably vivid colors; it’s much crisper than the one on Motorola’s Droid RAZR. It also retains the Nexus S’s subtly curved glass, which adds to the general feel of refinement.
Big-screen phones aren’t better than smaller ones by definition–in fact, they can be a tad unwieldy, especially for one-handed operation. (There’s a limit to how far your thumb can stretch.) But I enjoyed this one, and found that its roominess permitted some of the most error-free typing I’ve ever managed using an on-screen keyboard.
Thanks to Ice Cream Sandwich, the Galaxy Nexus dumps what was until now a signature Android feature: Its reliance on hardware buttons. Previous Android phones have had four of ‘em: One took you to the home screen, one let you step back to the previous screen, one pulled up menus and one was for search. It made for a cumbersome interface, especially since Google and phone makers kept changing their minds about the ideal order for the four buttons.
Like Android 3.0 Honeycomb tablets such as Motorola’s Xoom, the Galaxy Nexus doesn’t have any dedicated buttons on its front at all. Instead, there are on-screen ones that appear as needed and which swivel when you rotate the phone. They include the home button and the back one, plus one which pulls up thumbnail images of the apps you’ve recently used so you can bop between them. (A menu button appears when apps require it, but Google seems to be trying to wean Android programs off their reliance on menus.) All in all, the software buttons make for a much more streamlined feel than their hardware-based predecessors.


Ultrabooks: Bringing Sexy Back to PCs



Once upon a time, the PC had no rivals. Back in the era before smart phones, tablets, Internet-savvy HDTVs and other gadgets-come-lately, it was the most important technology product in the world, and therefore inherently exciting.
But with tech gear, familiarity breeds tedium. At his keynote at this week’s Consumer Electronics Show in Las Vegas, Microsoft CEO Steve Ballmer said there are now 1.3 billion Windows PCs on the planet. They’re as useful as ever, but most of them are also pretty mundane.
If you consider the PC to be a boring, utilitarian appliance, you’re far less likely to splurge on a new one. That’s a dangerous scenario for computer manufacturers, who would prefer that consumers and businesses feel the need for new systems as frequently as possible. It’s just as alarming for chip giant Intel, the company whose processors are inside most systems.
In 2011, Intel took matters into its own hands by creating a concept it called the Ultrabook–thin, light notebooks with an emphasis on pizzazz over raw specs. It reportedly decided to invest hundreds of millions of dollars in convincing PC makers to build them. A few Ultrabooks debuted last year, but the floodgates opened at this year’s CES. Nearly every major manufacturer introduced one or more more models at the show.
When I first heard about Ultrabooks, I feared the worst. I figured most of them would be unimaginative knockoffs of the MacBook Air, the whisper-thin wedge of a laptop that’s been a hit since Apple introduced its second-generation version in 2010. I also worried that they’d be montonously similar to each other, in the way that netbooks all tend to blur together.
I needn’t have fretted. True, some Ultrabooks look a little–or, in some cases, a lot–like Apple’s machine. (Asus’s Zenbook is one of them.) Conceptually, however, the Ultrabook isn’t a shameless Air knockoff. In fact, it’s remarkably amorphous, giving hardware companies the latitude to build all sorts of Ultrabooks for all kinds of people.
Intel does say that a notebook isn’t an Ultrabook unless it uses a power-efficent Intel processor, delivers at least five hours of battery life on a charge, is no more than 21mm thick, wakes up almost instantly when you open it up and uses a couple of Intel security technologies. But an Ultrabook doesn’t have to hit a particular price point, come in under a specific weight, or include a certain list of features.
That’s why the models unveiled at CES are hardly peas in a pod. Consider these notable contenders, and how different they are from one another:
  • Dell’s $999 XPS 13 looks like an optical illusion: Dell fit a reasonably spacious 13.3″ screen into a dinky (but handsome) case similar in size to the ones used by 11.6″ laptops. Dell’s also offering a souped-up Intel Core i7 processor option for the XPS; most Ultrabooks use the less potent i5 chip.
  • Rather than matching or beating the $999 starting price for the MacBook Air, HP decided to price its Envy 14 Spectre at an imposing $1399 and lavish it with features and technologies. The Spectre has Beats audio, individually-illuminated keycaps that light up when a motion detector notices you’re there, a bevy of full-sized ports and a unique case protected with Corning’s super-sturdy Gorilla Glass. (Confusingly, it’s thicker and heavier than Samsung’s identically-priced new Series 9 laptop–a sleek machine that Samsung doesn’t call an Ultrabook.)
  • Acer says that its MacBook Air-esque Aspire S5 (price not set) is the planet’s thinnest Ultrabook. It achieves that distinction through a feature that’s both useful and zany: When you press a button, a secret compartment on the back of the case plops down to reveal a full complement of ports. Another still-unpriced Acer Ultrabook, the Aspire Timeline Ultra, is available in a version with a roomy 15″ display and a built-in optical drive; it may be reasonably light and thin for a big notebook, but it’s still a big notebook.
  • Samsung’s Series 5 Ultra, starting at $849, comes in 13″ and 14″ variants. Both use hard drives rather than solid-state disks, and the 14-incher manages to cram an optical drive into its still-relatively-thin case.
Not all of the CES crop look like sure winners–Dell’s diminutive model is my early favorite–but most of them are evidence that their manufacturers are stepping up their game. The best ones are strikingly nicer than most garden-variety Windows laptops, which tend to be plasticky buckets of compromise.
For all the effort Intel put into drumming up enthusiasm for Ultrabooks at CES, it apparently regards the new systems as stopgaps. “Eventually,” an Intel blog post confidently says of future models,” you’ll think of an Ultrabook as a tablet when you want it, a PC when you need it.” The company’s line of thinking is in line with that of Microsoft, whose upcoming Windows 8 will attempt to take on the iPad while keeping users of conventional PCs happy.
Intel is already declaring that the Ultrabook tablet/PC hybrids it envisions will bring “historic” change to the computer market. I’m instinctively skeptical about that prediction: A device that tries to be both a tablet and a PC may end up serving two purposes poorly rather than one purpose well. (Bicycles are great, and so are cars–but I wouldn’t want to buy a bicycle/car combo.) If upcoming Ultrabooks are bad, consumers will notice and stay away in droves.
A computer doesn’t have to make history to be a step forward for the industry; it just needs to make everyday computing meaningfully better. Ultrabooks of the type that were everywhere at CES have a shot at doing just that–and if they end up the world’s default notebooks within a few years, as I think they will, Intel will have done both PC makers and PC buyers a major favor.

Ultrabooks: Bringing Sexy Back to PCs

Samsung Q4 2011: Record Profit On Strong Smartphones



* Estimates Q4 operating profit at 5.2 trln won vs 4.7 trln won consensus

* Smartphone sales seen at record 35 mln in Q4 vs 28 mln in Q3

* One-off gains seen at more than 500 bln won-analysts

* Shares down 0.8 pct after hitting record earlier in the week

SEOUL, Jan 6 (Reuters) - Samsung Electronics , the world's top maker of memory chips and smartphones, estimated on Friday its October-December profit would jump 73 percent to a lifetime high, aided by one-off gains and record-smashing sales of smartphones.

The South Korean firm, which surged past Apple as the world's top smartphone maker in the third quarter, is quickly building on its supremacy with sleek designs and a rich product line-up, while the latest models from the likes of HTC , Nokia and BlackBerry maker Research in Motion struggle to interest consumers.

Its handset division is now Samsung's biggest earnings generator, raking in record profits.

Samsung is also weathering a squeeze at its bread-and-butter memory chip unit with new revenue sources such as mobile processing chips and high-end OLED displays. Key rivals are increasingly turning to Samsung for components to power their tablets and smartphones.

The South Korean firm estimated its quarterly operating profit at 5.2 trillion won ($4.5 billion), compared with a consensus forecast of 4.7 trillion won by analysts surveyed by Thomson Reuters I/B/E/S.


The result would top Samsung's previous record profit of 5.0 trillion won earned in the second quarter of 2010 and is up 22 percent from the preceding quarter.

One-off gains expected in the fourth quarter include around 500 billion won from the sale of its hard disk drive business to Seagate Technology, and reduced mobile provisions involving royalty payments, according to analysts.

"Even excluding one-off gains, these are very solid results against a weak industry outlook," said Lee Seung-woo, an analyst at Shinyoung Securities.

"Samsung is likely to continue record-breaking earnings this year as earnings from flat screens and memory chips will improve, making up for any potential slowdown in handset growth rates. I'd expect profits to grow by another 5 trillion won this year."

SMARTPHONE GAINS

Samsung shares eased on Friday, falling 0.8 percent by 0045 GMT, after charging to a record 1.11 million won earlier this week in anticipation of an upbeat forecast. The company is Asia's most valuable technology firm with a market value of around $150 billion .

Smartphone shipments are forecast at a record 35 million in the fourth quarter, up one quarter from the preceding three months, when it first surged past Apple as the world's top smartphone vendor.

In 2012 it is expected to sell as many as 170 million smartphones, according to BNP Paribas and Korea Investment & Securities, the most bullish street view, from an estimated 95 million last year, powered by a diverse product portfolio that spans high-end Galaxy models to cheap phones using Samsung's own "bada" software.

Its latest Galaxy Note model, which runs on fast fourth-generation (4G) networks, is touted by some followers as a "phablet" as its 5.3-inch display and powerful dual-core processor makes it work as both a tablet computer and smartphone. Its successful debut in some European and Asian markets during the year-end holiday season has raised hopes for a solid U.S. launch in coming months.

"As expectations for Apple to continue its innovation trail is receding a bit, this will be the year when Samsung solidifies its commanding lead in the smartphone market," said Kim Yun-sang, a fund manager at IBK Asset Management, which owns Samsung stock.

Samsung, the world's biggest technology firm by revenue, estimated fourth-quarter sales at 47 trillion won. The company will provide detailed earnings later this month.

Major headwinds for Samsung in 2012 include slowing growth in global PC sales, which will dent sales of its core computer memory chips.

Weak computer memory chip prices will continue to squeeze earnings at least until the first half of this year. Prices of PC DRAM (dynamic random access memory) chips dropped about 30 percent in the fourth quarter alone, near to production costs.

Samsung remains the sole profitable DRAM chipmaker and is likely to fare better than rivals, helped by heavy investments to cut production costs with finer processing technology.

Its foray into the booming tablet market has been also hit by a global patent battle with Apple, which is seeking to ban sales of Samsung's tablets in major markets.
